This Policy has been written to inform you of the practices and conditions under which hubshop.fr collects, uses and stores your personal data (hereinafter: the "Data").

It describes the various Data that we may collect and process, or that you may provide to us, when you access and/or use the website https://www.hubshop.fr (the "Site") on which our products are sold. The term "Site" refers only to the website https://www.hubshop.fr.

Given the constant evolution of laws and regulations relating to technology and personal data protection, this Policy is likely to be updated. If you are a user of the Site, you will be informed of any changes by email.
If any clause of this Policy is declared void or contrary to regulations, it shall be deemed unwritten but shall not affect the validity of the other clauses of this Policy.

This Policy applies to Data collected:
• Through simple browsing of the Site
• Through emails exchanged between hubshop and you, or any other electronic messaging tool
• When you create a user account on the Site
• When you place an order on the Site
• When you subscribe to the Site's Newsletter (the "Newsletter")

It does not apply to information collected by any third parties or through websites operated by them, including through applications or content (including advertisements) redirecting the user to the Site. Please read this Policy concerning the processing of your Data carefully. We inform you that browsing our Site necessarily implies acceptance of this Policy. If you do not agree with it, we invite you to leave our Site. It is your responsibility to ensure that the Data provided to hubshop is accurate. Where applicable, you can correct and update it from your "My Account" area.

1. WHAT DATA IS COLLECTED BY SITE NAME?

Depending on the nature and purpose of your interaction with Hubshop (creating a user account, subscribing to the Newsletter, filling out contact forms, as well as during any telephone conversations), we may collect the following Data:
• Your email address will necessarily be requested if you wish to create a user account, contact us through the contact forms and/or receive our Newsletter
• Data relating to your identity, such as your last name, first names, email address, postal addresses and telephone numbers, may be requested
• Browsing Data: this is Data relating to the way you use the Site, including: IP address, browser used, browsing duration, search history, operating system used, language and pages viewed
• Data concerning your visits to the Site, including traffic data, log files and other communication data or resources you use when accessing the Site
• Order Data: your postal address is required to issue invoices. Likewise, your bank, PayPal or other financial partner details must be provided to process payment for your order
• Data relating to the use of social networks when you use their features.

2. HOW IS YOUR DATA COLLECTED?

Data may be collected in different ways on the Site. Data may be collected directly when you provide it to us through the contact forms, user account creation forms and Newsletter subscription forms available on the Site, and/or when you contact us by telephone. When you contact us through these various means, a copy of your exchanges with Hubshop, including email addresses, may be made and archived. Hubshop also collects certain Data indirectly by means of cookies/tracking technologies. We invite you to read our Cookie Policy, designed to help you better understand these technologies and how we use them on the Site and in connection with our services, applications and tools.

3. WHY IS YOUR DATA COLLECTED?

If you are a regular user, we collect your Data to:
- Send you our Newsletter and/or personalized commercial offers if you have consented to this
- Manage orders and perform the contract
- Ensure the security and traceability of purchases made on the site
- Send you information about your account (including purchase invoices and order history)
- Handle requests submitted through the contact page
- Allow you to leave a review of the products and/or the Site
- Inform you of changes to the Site or to our range of products and services
- Comply with our rights and obligations set out in the contracts concluded with users, and for any other lawful purpose.

We may also use cookies or trackers:

4. WHO PROCESSES YOUR DATA?

Your Data is processed by Hubshop staff and associates responsible for:
- Site management (orders and shipments)
- Customer support, to answer all your questions
- Invoicing.

In addition, in the course of our business and for processing purposes, your Data may be disclosed to subcontractors, service providers or other third parties, in particular:

  • - Banque Populaire or Alma

  • - Carriers (La Poste, Colissimo, DPD, UPS...)

Each of these parties is bound by a confidentiality commitment regarding the use and processing of personal data.

For payment management and to make things easier for its users, Hubshop offers the following payment methods for purchases on the Site:
- Online payment by bank card (Carte Bleue, Visa, Eurocard / Mastercard) handled by La Banque Populaire.
- Online payment via PayPal
- Payment by bank transfer
- Payment by check
- All your other payment methods (ALMA installment payments)

Hubshop has no access to your login credentials or bank card numbers. All transactions are secured using SSL encryption, guaranteeing both the identity of the payment provider and the confidentiality of your data.

For sending our Newsletters, our email campaigns are managed through the services of Sendpulse Inc- 220 E 23rd St #401, New York, NY 10010.

All of the aforementioned subcontractors, service providers, Partners or other third parties are bound by contractual obligations to respect the confidentiality and protection of the Data and to process it solely for the purposes for which we provide it to them.
Your Data may be transferred to any purchaser or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Hubshop's assets, whether due to uncertainty or as part of bankruptcy, liquidation or other proceedings in which Hubshop users' Data is among the assets transferred.
Finally, we may also disclose your Data:
- to comply with any mandate required by applicable law, including government and regulatory requests
- if we believe that disclosure is necessary or required to protect the rights, property or safety of Hubshop, its customers or other stakeholders.
Any such disclosure includes exchanging information with other companies and organizations for the purpose of protection against fraud and counterfeiting.

The Site may contain links to various websites and social media platforms run on third-party servers by individuals or organizations over which Hubshop has no control. Consequently, we cannot under any circumstances be held responsible for how your Data is stored or used on these third-party servers. We recommend that you read the personal data protection policy of each third-party website you access via the Site in order to understand how your Data will be used.

5. HOW LONG IS YOUR DATA KEPT?

Hubshop keeps your Data only for as long as necessary for the purposes set out in Article 3. This retention period varies depending on the Data concerned, as the nature and purpose of the collection may affect it. Likewise, certain legal obligations require a specific retention period.
If you are subscribed to the Newsletter, we keep your email address until you unsubscribe.
When you contact Hubshop using the contact form or communicate with us by phone, your data may be kept:
- for up to one (1) year from the last contact if you do not have a customer account or have not placed an order on the Site.
- for up to ten (10) years (legal period) from the last order placed on the Site, if this information relates to that order.
- In all other cases, the retention period for this exchanged Data may not exceed one (1) year.

With regard to your user account, all your billing data is kept for ten (10) years from the date of purchase, even if you have requested the deactivation of your user account.

If you submit a request to delete your Personal Data, your Site user account will be deactivated and anonymized, then permanently deleted at the end of the above-mentioned periods, starting from the day you made the request. Finally, Data collected through cookies or trackers will be retained for up to six (6) months for audience measurement cookies or trackers and up to thirteen (13) months for all others. Beyond the above-mentioned retention periods, your Data will be anonymized and retained for statistical purposes only.

6. HOW IS YOUR DATA PROTECTED?

Your Data is stored on a secure server protected by a firewall and antivirus software. We have implemented technical and organizational measures designed to ensure the security and confidentiality of your Data against accidental loss and against any unauthorized access, use, modification, and disclosure. However, given the inherent characteristics of the Internet, we cannot guarantee optimal security of information exchanged over this network. We strive to protect your Data, but we cannot guarantee the absolute security of information transmitted to the Site. You agree that you transmit your Data at your own risk. We cannot be held liable for any failure to comply with the privacy settings or security measures in place on the Site. Accordingly, you agree that the security of your information is also your responsibility. For example, it is your responsibility to keep the password used to access your user account secret. Never disclose it to third parties. Likewise, be careful when disclosing information in public sections of the Site, as these may be viewed by any Site user.

7. WHAT ARE YOUR RIGHTS?

You can choose how the Data you provide to us is used:
- You can browse the Site without providing any Data. In that case, you will not be able to use certain Site features, in particular making purchases (if you are a regular user) and/or downloads on the Site.
- You can refuse to provide your bank or PayPal details and/or your postal addresses. In that case, you will not be able to make purchases on the Site
- You can choose to stop receiving the Newsletter and our personalized offers: simply log in to your Site user account or click the link in the email sent to you.

In any event, you can access your user account at any time to view or update your Data and unsubscribe from our Newsletter if you had subscribed. In accordance with the applicable regulations on personal data protection, in particular European Regulation 2016/679 on Data protection (the "GDPR") and French Law No. 78-17 of January 6, 1978, known as the "Informatique et Libertés" law, as amended, you have a right of access to and a right to rectify your Data.

In addition, subject to the conditions set out in said regulations for exercising these rights, you have:
- A right to erasure of your Data (excluding accounting data, which must be retained for 10 years under French law, Article L123-22 of the French Commercial Code)
- A right to restriction of the processing of your Data
- A right to object to the processing of your Data on legitimate grounds, in accordance with Article 21 of the GDPR
- A right to portability of the Data you have provided (for automated processing based on consent or the performance of a contract)
- The right to withdraw your consent, where it has been requested from you. Where the processing of your Data is based on your consent, you may withdraw it at any time.

You acknowledge, however, that processing carried out before the withdrawal of your consent remains fully valid. You also have the right to object, without giving any reason, to Hubshop analyzing your Data in order to share it for marketing purposes.
However, in accordance with Article 12.6 of the GDPR, in order for you to exercise these rights, Hubshop, as the controller of this processing, reserves the right to ask you to verify your identity. Please note that the data used to verify your identity will be deleted once we have responded to your request. We have one month to respond to any request relating to the exercise of your rights. This period may be extended by two months due to the complexity or number of requests.

8. STORAGE OF DATA COLLECTED BY HUBSHOP
